happening now the shunt on for a bay area man who police say abducted his two kids, then sailed away on a stolen boat. christie smith is live in alameda with what police are doing. good morning. >> reporter: good morning to you. they are trying to get the word out to the public and there is a warrant out now for the father's arrest and there's already been an extensive search for the father and the children near the vallejo area, so far no luck. what investigators say is that they believe that the father came here where we are here in alameda on tuesday, and sailed away in a stolen 40-foot sail boat with his two small kids from club nautique harbor. they say christopher maffei took the kids from their mom's home and drove to alameda and ditched it here and that he had been to alameda a couple of weeks earlier with the kids talking

about possibly buying a boat. it's believed that they could be sailing to mexico. the father again 43-year-old christopher maffei, brooklynn is three, seen wearing a white dress with blue and green designs. 2-year-old devin was wearing a short sleeved sponge bob shirt and a diaper. the sail boat a white hunter 41 with blue canvas, named unleashed with the hull number hun41366 c 707. if you have any information you are asked to call san francisco police. they consider these kids abducted. reporting live, christie smith, "today in the bay." >> east palo alto police now searching for two men who robbed a couple at gunpoint in a bold home invasion. it happened wednesday afternoon at a home on jasmine way near 101. two masked men followed the couple into their home and

forced them to lay on the floor. the suspects spent a half hour ransacking the house before making off with cash, jewelry and a computer. we're happy to report nobody was hurt. >> the man accused of gunning down a well known east palo alto activist is expected in court today. 60-year-old gregory elong is expected to enter a plea. last month he was declared competent. police say he killed lewis, a community activist who went from being a convicted criminal to running a program designed to help people in the same situation get back on their feet. the two were childhood friends. police still do not have a motive. >> the teenager charged with vehicular manslaughter for the death of a father and daughter in concord will also be in court today. the prosecutors have decided to charge the 17-year-old david rosen as a minor in the case. rosen is accused of hitting and killing the father and his

daughter as they were riding their bikes. nuri's family hoped that rosen would be charged as an adult. >> decision 2012. after busy weeks of conventions both president obama and mitt romney will be reaching out to undecided voters this morning, last night was a pivotal speech for president obama as he made his case to the american people for a second term and he thrilled supporters but his goal was far beyond that convention hall. >> if you believe in a country where everyone gets a fair shot and everyone does their fair share and everyone plays by the same rules, then i need you to vote this november. >> in his speech president obama taking credit for saving millions of american jobs in his first term, in his second term he says he would focus on the middle class. and looking forward to president's favoring keeping education and green energy programs, keeping medicare like it is, and he wants the rich to pay more for that. the pace will pick up with four

debates ahead between romney and obama, and election day now, counting, 59 days away. >> in other news, the enthusiasm is high but the numbers are down this year, the susan g. komen race for the cure this morning in san francisco. it appears that controversy sparked when the organization refused to fund planned parenthood is having an effect. bob has more on this story. >> reporter: good morning. i got off the phone with a spokesperson for the local chapter of susan g. komen for the cure. she confirms that locally donations are down by almost 65%, and registration for sunday's 5k race for the cure, the local affiliate's fund-raiser down by almost 50% compared to last year. new video shows the starting area for the other event, the three-day, 60-mile walk that starts a couple hours from now. the local affiliate is suffering because of a controversial

decision the national branch made nine months ago. the headquarters pulled almost $700,000 in funding to planned parenthood four breast screening because planned parenthood was under investigation for using government money to pay for abortions. there was an uproar, headquarters reversed its decision but the public relations damage was done. the local affiliate is upset because it never supported that initial decision, it spoke out against the stance before they reversed themselves, regardless people are venting their anger locally, this time last year the bay area branch had raised around $212,000 in its fight against breast cancer. this year donations are at around $76,000. in about a half hour we'll speak with a national spokesperson for this weekend's three-day walk. >> thanks so much, bob. 5:06. richmond's proposed tax on soda has moisted into a battle over

freedom of speech. that case is heading to court. a city law requires all major contributors against measures like the soda tax be lifted on campaign literature. the beverage industry coalition says that violates freedom of speech. city leaders say they are trying to inform voters about the groups behind political campaigns. the proposed penny per ounce tax intended to fight childhood obesity will be voted on during the november election. >> phyllis simpkins donated to help out her alma mater. san jose state saying a thank you with an honor. she died in july at 87 is now is memorialized at morris daly auditorium. she and her husband pledged 20 million to san jose state, the gifts supporting a range of programs from the marine laboratories to their marching

band. >> a nice tribute. time to check out the forecast with meteorologist christina loren. how are we looking? >> it's kind of cool out there but not too bad. we have a great looking day shaping up. some of the best weather all year long occurs in this time frame right between summer and fall. 48 degrees in novato, 54 to start out in san francisco, and we're at 59 crisp degrees in sunnyvale. it's cool enough to where you can go for a run without getting overheated. you might be on the warm side in livermore. we're forecasting the upper 80s. but hey, we're done with the 90s, and we're going to continue that cooldown. the weather story is how clear it's going to be right off the bat. as you know we had an active weather pattern, especially in the south and east bay. today we still have a little bit of instability. but that keeps that dense fog from settling to the surface. breezy out there, 78 degrees in redwood city, 78 los gatos and 78 in santa cruz. san francisco, you'll see the sunshine today by about 9:00 a.m. we do have changes just around the corner.

the discrimination suit filed against in-n-out burger hope more will come forward. the suit was filed this week on behalf of two african-american men over the age of 40 denied employment by in-n-out. the attorneys say both of the clients were qualified for the jobs that they applied for and the attorney believes he has a solid case against the popular chain. >> we believe their story since necessarily an outliar, it's a much more larger practice that the company is engaging in. >> in response the company's vice president and general counsel is quoted saying, we hire from our local communities and our restaurants reflect the demographics of that community. the company will aggressively defend itself against these baseless and irresponsible allegations. in-n-out h in-n-out is paying its entry level employees more than

minimum wage. >> a little more than 15 minutes from now the labor department will announce the latest jobs numbers. scott, you tell us month after month to ignore the unemployment rate. >> yeah. concentrate on the jobs gains instead. that's what really tells us what's going on. today, laura, i am suspending that advice. why? because politicians on both sides will be concentrating on the unemployment rate. it's an easier number to deal with and analysts like to point out no president since fdr has been re-elected when the unemployment rate is over 5%. or 8%, rather. problematic for president obama dealing with 8.3%. 163,000 jobs added to the economy last m. let's check in with courtney reagan at cnbc. a big rally yesterday, big important jobs numbers today. >> yes, that's right. futures are higher now after yesterday's huge rally so it could be more of a carry over from that, anticipation of the

jobs report and yesterday's rally was sparked by the european central bank which launched a stimulus program to buy up billions in bonds from countries like spain and italy. today's focus as you suggested does turn back to the u.s. economy, with the monthly jobs report, that's in less than 15 minutes from now. forecast calls for another month of modest growth in august, about 125,000 new jobs added. like you were explaining, there are two numbers to pay attention to. the number of jobs gained and the unemployment rate and they come from two surveys. more jobs added and the unemployment rate can stay the same or even go up, and this time around it's expected to hold at 8.3% like you said, the jobless rate has been above 8% for 42 straight months. the dow jumped 244 points yesterday to 13,292, that's a new 4 1/2 year high, the nasdaq rose to 3135, that's the highest level in more than 12 years, welcome back to the year 2000.

the nfl season is just getting under way this weekend and another high stakes game is entering the 2-minute drill. cbs is expected to say it sold 90% of the ads for superbowl xxxvii. the going rate is reportedly $3.8 million up from $3.5 million when it was on nbc earlier this year. >> have a great friday. e-books could get cheaper a. judge ordered publishers to stop setting their prices, let sellers do it. prices on electronic books jumped until publishers they could decide how much to sell books for and apple would take a third of that, and agency model of selling. lots of people wondered why an e-book is sometimes just as expensive as a regular book even though there is no paper, ink, no storage, the government says it was because of this price fixing. critics say the downside of this decision is it makes it harder

if not impossible for a new e-book tablet to come out into the market. big guys will drive them out of business. amazon has proved it's willing to take a loss to increase market share so. when this price goes down, that's the downside of that. >> interesting to see. thanks so much. >> 5:17. what we're focusing on is the weekend and what kind of weather. >> it's going to be nice. it is going to be so nice. all the cities, yeah, you know what i mean, that's what i like to tell you. pretty soon i have to tell you it's going to be raining on your weekend plans so you want to put all things into perspective. 55 in concord. we're at 55 in livermore and 56 degrees in san jose. so what i can tell you is that muggy conditions, all of that humidity we had to deal with, is drying out nicely. we still have a little bit of moisture lingering to the south. and so it might be sticky for the first part of the day. what's happening is high pressure is moving in. we'll be back to our dry heat today and temperatures aren't going to be that hot even in the

warmest cities across the bay area. it will be a little on the warm side, livermore about 88 degrees. as we head through your friday, temperatures will be nice to start. we're going to see clear conditions off the bat. san francisco, 66 degrees with abundant sunshine by about 9:00 a.m. 78 degrees today in redwood city. 71 in santa cruz. 78 in san jose. that's the kind of weather you want to the go out and jog in. you want to take that walk because once it's a little warmer next week, we're going to be back in the mid 90s. it won't be as invigorating for you. you won't have as much incentive. 83 on saturday. you see that extra boost when it comes to exercise. 89 on monday. then we get hot again, tuesday into wednesday next week. back to the 90s, mid-90s on thursday. overall the kids are back in school next week. you want to make sure you're dressing them for the two parts of the day as it's chilly in the morning. 5:18. let's check your drive. hi, mike. >> good morning. we'll look to san jose. the volume of traffic starting

to build for 101, no real slowing, this is north of 680, 280, one of our first spots to show the dip in the speeds. a gauge for the palo alto area up the peninsula as well. a smooth drive we see crews here at university, and actually over there at the top of the screen you do see flashing lights so crews on the move. no lanes blocked at university. you might find more crews heading north. i don't see a lot of slowing on the peninsula. we'll get to the maps, for the east bay we'll show you that out of the alta mont pass, mild speeds still around 60. the upper 50s as you head through the altamont pass through livermore with no real issues into pleasanton. 680 has the crew through san ramon into danville. slowing earlier, the crews may be on the move but nothing big as far as delays in either direction for 680. a live look at the bay bridge, no big volume here. easy drive down the east shore freeway. across the span, and in the north bay, san rafael moves smoothly. this is southbound.

back to you. >> thank you. you likely know him assen astronaut but he was a navy man for much of his life. keeping with tradition, neil armstrong is all set to be buried at sea. his family says it was his wish but have not released details of that burial. the navy confirming it would perform that but would not say when or where citing the family's wishes for privacy. a public memorial for armstrong will be held set for september 13th at washington national cathedral. >> tom brokaw is a-okay, as we told you yesterday the 72-year-old was taken to the hospital in charlotte after feeling light headed. it turns out the former anchor of nbc's nightly news had mixed up his medication on twitter he said all is well, early a.m. i took a half dose of ambien and made less sense than usual. glad he's okay.

this morning a search for a missing bay area college student has gone global. 20-year-old student brett olson disappeared sunday during an annual labor day river float that he took on the sacramento river. while police are searching by land, friends, strangers even some celebrities looking for the man on line. 66,000 people have joined facebook page dedicated to the search. twitter abuzz with howie mandel, and kerri walsh. >> i think everybody realizes he is someone's brother and son and someone's best friend. it hits home. >> dozens of posters have been put up in windows of many downtown businesses in lafayette. >> just in to our newsroom, we've been waiting for them, the new job numbers released. economy playing a big role in the presidential election of course and these numbers could help set the tone. scott mcgrew with a look, good or bad news?

>> well, depends on which side of the politics you lie. it's 96,000 jobs added in the month of august. that is a lousy, lousy number compared to what we were expecting which could have been as high as 150, even 200,000. now, unemployment rate drops to 8.1%. and you know month after month i tell you to ignore that number. i guarantee you this month that obama administration in particular is going to love that number. technically it doesn't mean as much as they hope it does. it's really the overall jobs added to the economy that's going to make a difference. people, families earning money. but the unemployment rate does drop .02 to 8.1% and the democrats will see that as a good piece of news t republicans will have problems arguing that. normally i don't get into the political side of this but jon, this is a very political season.

96,000 jobs added, 8.1%. back to you. >> scott, thank you. new this morning, two people are dead in vallejo and police now are looking for the suspects who shot them. police found the victims in a home on atherton street. police say the 31-year-old man and 28-year-old woman had been shot. neighbors say they thought they saw two people, two men, wearing hoodies running away from the scene moments after hearing pops. no word on a possible motive. >> a third person has died from the hantavirus outbreak. that is prompting park officials to raise another warning about the disease. the the recent victim, a west virginia man. he stayed in a tent cabin at the lodge and camped in the high country. seven additional cases are linked to the signature tent cabins. the authorities say as many as 22,000 people may have been exposed to the virus over the

summer. that's double the original estimate. the hantavirus is often transmitted by deer mice and their droppings. the initial signs of the virus often mimic the flu. >> the susan g. komen race for the cure returning to the bay area for the first time since that big time funding scandal that took place about nine months ago. bob redell is live with the effects of this on things. >> reporter: good morning. donations to the local chapter of the susan g. komen for the cure are down 65%. registration for the 5k race down 50% because of the controversial move komen made nine months ago. in january the national branch announced it was stopping funding for planned parenthood because planned parenthood was under investigation for using government money for abortions. there was an uproar. hq reverse the decision but the damage was done. joining me is dr. phillips, a

national spokeswoman with the three-day, the 60-mile walk that starts in about an hour. good morning to you. thank you for joining us. >> good morning, bob. thank you for having me. >> i know you can't speak on behalf of the local chapter. from a national perspective how much are donations down for events like the three-day? >> you know, this is our sixth event of our 14 three-day events for season so it's difficult to say what our numbers are going to look like. i can tell you the great people of san francisco bay area, we have nearly 1200 participants that are showing up this morning, ready to walk 60 miles all to put an end to breast cancer. >> as you heard me say moments ago, locally donations and registration are down. what do you say to people still upset over the planned parenthood decision in january? >> i tell those individuals that funds from the susan g. komen
